This Privacy Policy sets forth how Moovea Group Inc., also doing business as Flexter (hereinafter, “Moovea,” “we,” “us,” or “our”) collects, uses, discloses and protects the personal information of any User of the Services offered by Moovea. You may access our Services through the Platform provided by Moovea in the manner described in Moovea’s Terms and Conditions of Use (hereinafter, the “Terms of Use”). This Privacy Policy is designed to comply with Canadian federal and provincial privacy laws. In the event of a conflict between this Privacy Policy and the Terms of Use, the Terms of Use shall prevail. Capitalized terms not otherwise defined herein shall have the meaning given to them in the Terms of Use.

1. ACCEPTANCE

The use of Moovea’s Services is subject to your compliance with this Privacy Policy. If you do not agree to be bound by the terms and conditions herein, please do not access or use our Services.

2. AMENDMENTS TO THE PRIVACY POLICY

We reserve the right to amend this Privacy Policy at any time and without notice. You agree to regularly review our Privacy Policy when using our Services so that you are aware of any changes to its content. Your continued use of our Services following the posting of changes to this Privacy Policy constitutes acceptance of those changes

3. CONSENT

Your consent to the collection, use, or disclosure of your personal information must be clear, free and enlightened. It must be given for specific purposes. Depending on the nature and sensitivity of your personal information, your consent can be express (it being understood that such consent may be given electronically) or implied (such as when you provide information voluntarily). Generally, we will seek your consent at the time of collection, except when required or otherwise authorized by law.

Your consent can be withdrawn at any time, subject to legal and contractual restrictions and reasonable notice. Please note that if you choose to withdraw your consent, we may not be able to provide you with our Services.

4. THE TYPE OF INFORMATION WE COLLECT ABOUT YOU

Moovea only collects personal information that is necessary to operate and maintain its Services. When creating a User Account or using our Platform, you will be asked to provide certain personal information that we will collect. This personal information includes, but is not limited to:

  • First and last name;
  • Mailing address;
  • Telephone number;
  • Email address;
  • Credit card number;
  • Password associated with a User Account, if applicable;
  • Language of choice for the use of our Platform;
  • Driver license information.

In addition, we collect, convert and store the data and information that you may upload or have access to on our Platform when using our Services. If you add data and information to your account after they have been uploaded by you or by another User, we can add such data and information to all or part of the previous data and information collected, rather than store a copy.

When you use the Services, and to the extent that it is necessary and related to the Services, we automatically record data and information from your desktop, laptop, cell phone, tablet or any other publicly available electronic device.

Some devices allow us to access geo-referenced information in real-time (for example, GPS). The Services may require and use such information.

Generally, we obtain personal information directly from you. However, we may collect personal information about you from outside sources with or without your consent, if permitted by law.

5. COOKIES

Your use of our Platform allows Moovea to automatically compile certain information regarding your user profile, which may include the Internet Protocol address (or IP address) of your computer, the operating system you are using, the identity of your Internet service provider, the date and time at which you accessed our website, the previous website you visited that provided you with a link to our Platform, and the content you viewed and downloaded from our Platform.

To this end, our Platform uses cookies that are stored on your device when you visit the Platform. Among other things, we use this information to tailor our Platform and its Services to your preferences and compile statistics about the consultation and use of our Platform and its Services to improve them.

With most Internet browsers, it is possible to erase cookies from your computer’s hard drive, block the creation of cookies, or receive a warning before a cookie is stored. However, in doing so, your use of our Platform may be affected, and you may no longer have access to all of its features

6. HOW WE USE YOUR PERSONAL INFORMATION

Moovea may use your personal information for the implementation and proper operation of our Services, which includes, but is not limited to:

  • identify you as a user of our Platform and associate you with a User Account, if applicable;
  • allow you to make Reservations with Partners through our Platform;
  • facilitate your connection with Partners;
  • provide you and Partners with a simple and efficient online payment method by which you can pay a Partner for a Reservation;
  • understand your needs and interests;
  • personalize and enhance your experience;
  • improve the range of Services offered, including the use of our Platform;
  • update our Services;
  • communicate with you when you submit questions, comments and suggestions;
  • provide you with information about our Services that may be of interest to you;
  • prevent errors and fraud;
  • meeting legal requirements.

We may also use your information to compile anonymous datasets, compile statistics, and detect trends discovered through our Platform’s aggregate use by Users.

Your personal information shall not be used for purposes other than those described above, except with your consent or as required or authorized by law.

7. HOW WE SHARE YOUR PERSONAL INFORMATION

We recognize that, except in the cases and under the conditions described hereinafter, the disclosure of your personal information to a third party requires your consent.

Access to your personal information within Moovea does not require your consent. However, access to your personal information is strictly limited to the persons for whom the information is necessary for the performance of their functions and duties.

We may also share your personal information, without your consent, with mandataries, consultants, data processors, payment service providers and other service providers who require such information in connection with Moovea’s business. Such mandataries, consultants, data processors, payment service providers and other service providers will contractually guarantee to Moovea that they will use your personal information exclusively to provide specific services and that they will keep it confidential in accordance with this Privacy Policy and return it to Moovea once the service has been provided, without keeping any copy.

By placing a Reservation on our Platform, you agree that Moovea may share your personal information with the particular Partner to connect you with said Partner and to enable it to provide you with rental services. Our Partners are not controlled by Moovea, and any personal information shared with them is subject to their privacy policies and security practices. Therefore, we encourage you to read the privacy policies of any Partner with which you place a Reservation through our Platform. Please note that these Partners may also contact you, if necessary, to obtain additional information about you, to answer questions you may have asked them, or otherwise to deliver the rental services to you in accordance with any Reservation you have made on our Platform.

We may share your personal information with a third party if it obtains your consent, such as when you choose to access our Services via a third-party application. Moovea is not responsible for what these third parties do with your information. You are solely responsible for ensuring that you trust the third party and that it has a privacy policy acceptable to you.

We may also, without your consent, communicate your personal information as authorized or required by law.

If Moovea is a party to a merger, acquisition, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. However, Moovea will notify you (e.g., by e-mail and/or by visible notice on the Platform) of any change of control, any use of your personal information or content, or if your personal information or content becomes subject to a different privacy policy. Moovea will also inform you of the choices available to you with respect to your personal information.

In each situation where Moovea may disclose your personal information, it will endeavour not to disclose any more personal information than is required under the circumstances.

Please note that if the third party to whom Moovea discloses personal information about you is located in a foreign jurisdiction, local laws may otherwise allow your personal information to be accessed by third parties without your consent

8. HOW WE KEEP YOUR DATA SECURE AND ACCURATE

Moovea has put in place a series of security safeguards to protect your personal information against loss or theft, as well as against any unauthorized access, disclosure, copying, use or modification. These security safeguards include physical measures, organizational measures and technological measures that are reasonable given the sensitivity of the information, the purposes for which it is to be used, the quantity and distribution of the information, the medium on which it is stored and the standards in the marketplace. However, no measure is infallible, and Moovea cannot guarantee that your personal information will be fully protected.

Moovea also takes the necessary measures to ensure that all its employees are informed about this Privacy Policy’s contents and understand that they must conform to it at all times.

It is your responsibility to adequately protect your User Account password (if applicable) and not to disclose it to anyone. It is also your responsibility to contact Moovea immediately if you discover any unauthorized use of your password or any other security breach.

Moovea recognizes that it is important to keep personal information accurate, complete and up-to-date, and takes reasonable steps to ensure the accuracy and completeness of the personal information it uses or discloses. However, you are responsible for informing Moovea of any significant changes in your personal information that may arise during the course our business relationship.

In accordance with this Privacy Policy and the Terms of Use, we will only retain your personal information for as long as is necessary to achieve the purpose for which it was collected, to meet legal data retention requirements, and as long as needed to protect our legitimate business interests. Subject to the terms of the Terms of Use, you may terminate your subscription to our Services or request that your information no longer be used to provide our Services. Moovea may retain and use your information as necessary to comply with legal requirements, resolve disputes, and enforce agreements per such requirements.

9. EXTERNAL LINKS

Our Platform may contain links to other external websites. When you use these links, you leave the Platform, and Moovea has no control over external websites. Accordingly, Moovea assumes no responsibility for the protection and privacy of any personal information you provide while visiting such websites, and this Privacy Policy does not govern such websites.

10. PHISHING

Identity theft and the practice currently known as “phishing” are of great concern to Moovea. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or personal identification numbers in an e-mail or an non-secure or unsolicited telephone communication. We suggest you not respond to and promptly report any e-mail or telephone communication purporting to be from Moovea in which such information is collected

11. ACCESS & CHANGE REQUESTS

Questions or concerns regarding this Privacy Policy or the collection, use and disclosure of your personal information, including requests for access or rectification, should be made in writing to :

You have the right to consult and obtain a copy of your personal information held by Moovea. You can also request that your personal information be rectified if it is inaccurate, incomplete or equivocal, or if its collection, disclosure or retention is not authorized by law.

Moovea will respond to every request for access and rectification within 30 days of receiving the written request. If we cannot provide access to or rectify your personal information, we will inform you of the reasons why your request was denied, subject to legal restrictions, and will provide you with any recourse available.

12. INTERNATIONAL TRANSFER AND APPLICABLE LAW

Your personal information may be transferred outside of the jurisdiction in which you reside and may be stored or otherwise maintained on information systems and devices located in jurisdictions where the privacy laws differ from and, in some cases, may not be as protective as those in your jurisdiction. If you are located outside of the province of Quebec and choose to provide us with personal information, Moovea can transfer your personal information to the province of Quebec and processes it there. Your consent to this Privacy Policy followed by the transmission of your personal information to Moovea represents your agreement to such transfer as well as your acknowledgement and acceptance that the treatment of your personal information will be governed by the laws of the province of Quebec and the applicable federal laws.
